Terms of use

1. Scope

These Terms of Use apply to your use of the FitsMySize app (iOS and Android) and the website fitsmysize.uprank.de (together, "the Service"), provided by Jan Henning Günzel, Julius Leber Straße 12, 32107 Bad Salzuflen, Germany (contact: kontakt@uprank.de; further details in the imprint).

By creating an account or using the Service, you agree to these Terms of Use. If you are a minor, you need the consent of a parent or guardian.

2. Description of the service

FitsMySize helps you find clothing that matches your actual body measurements. You measure yourself once during onboarding, then get fit assessments for listed products, can save products, give fit feedback on sizes, and comment on products.

FitsMySize is not an online shop: the Service lists products from other providers and links to the respective shop. Purchases are made directly with the linked shop — we are not a party to that transaction (see § 7).

The Service is currently offered free of charge. We reserve the right to introduce paid features in the future; any such change would be communicated separately in advance.

3. Registration and account

Certain features (saving measurements, bookmarking, giving feedback, commenting) require an account, created via email/password or Google/Apple sign-in. You must keep your credentials confidential and notify us promptly of any misuse of your account.

You can permanently delete your account at any time in the app's Settings; this permanently removes your measurements, fit feedback, saved products and comments (details: privacy policy).

4. Minimum age

The Service is intended for people aged 16 and older. If you are under 16, you may not create an account.

5. User content and conduct

If you comment or give fit feedback, you remain responsible for that content. You represent that you will not post content that is unlawful, infringes third-party rights (e.g. copyright, trademark or personality rights), is abusive, discriminatory or harassing, constitutes spam or advertising without our consent, or knowingly misstates fit.

You grant us a simple, worldwide, non-exclusive license to use content you submit to the extent necessary to operate the Service (e.g. showing your feedback to other users). You retain ownership of your content.

We may remove content that violates these rules and suspend accounts for repeated or serious violations. Report content to kontakt@uprank.de — we review and respond promptly.

6. Fit recommendations — disclaimer

The fit assessments shown are based on a rule-based comparison of your measurements with the known or assumed product measurements, plus — where available — feedback from other users. They are guidance, not a guarantee.

Actual fit depends on factors we cannot fully capture (e.g. individual wearing preference, material variance, manufacturing tolerances, outdated or inaccurate manufacturer data). We accept no liability for a product actually fitting as shown.

7. Affiliate links and partner programs

Some product links in the Service are affiliate links. If you make a purchase through them, we may receive a commission from the retailer — at no extra cost to you. The purchase contract is formed exclusively between you and the respective retailer; the retailer alone is responsible for price, availability, delivery, and withdrawal/warranty rights. We have no control over external shop websites and accept no liability for their content.

8. Intellectual property

The design, brand, logo and software of FitsMySize are protected by copyright and trademark law. Without our prior consent, you may not reproduce, modify or use them for your own purposes, other than the intended use of the Service.

"Uprank" is a word mark of Jan Henning Günzel, registered with the German Patent and Trademark Office (DPMA). Using the name "Uprank" or any confusingly similar sign without our prior consent is not permitted.

9. Availability and changes

The Service is in active development (beta). We aim for high availability but do not guarantee uninterrupted operation and may change, extend or discontinue features at any time — particularly during the beta phase.

10. Termination

You may stop using the Service at any time by deleting your account in Settings or uninstalling the app. We may suspend or delete accounts that violate these Terms of Use with reasonable notice, or immediately in the case of serious violations.

11. Liability

We are liable without limitation for intent and gross negligence, under the Product Liability Act, and for damages arising from injury to life, body or health. For slightly negligent breaches of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Liability for slight negligence is otherwise excluded.

12. Changes to these Terms of Use

We may update these Terms of Use, for example for new features or legal requirements. We will inform you of material changes in good time, e.g. by email or in-app notice. If you do not object within four weeks and continue using the Service, the change is deemed accepted; if you object, you may terminate your account.

13. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the law of your habitual residence remain unaffected. If you are a consumer, the statutory place of jurisdiction applies exclusively.

14. Final provisions

Should any provision of these Terms of Use be invalid, the validity of the remaining provisions is unaffected. Questions about these Terms of Use go to kontakt@uprank.de.
